ADR Session on Dispute Avoidance and Mitigation Strategies – International Perspectives

The Tanzania International Arbitration Centre, in collaboration with ADROIT / KQI Professional Alliance (India), successfully hosted an ADR session titled “Dispute Avoidance and Mitigation Strategies – International Perspectives”. The session focused on key lessons from international construction arbitration cases, highlighting practical strategies for preventing and managing disputes in the construction industry.

The interactive panel featured distinguished ADR experts, including Mr. Ramasubramanian FCIArb, Brigadier Amit Kathpalia, MRICS, FIE, FICCP, Sr PE, and Mr. Amod K. Dalela MSW.LLM.FICA.FAIADR.FCIAC (both from India) who shared valuable international best practices and real-world insights drawn from their extensive experience in construction arbitration. Participants gained practical knowledge on dispute avoidance and mitigation, exploring how proven global strategies can be adapted to strengthen contractual relationships, minimize project risks, and enhance dispute management in the local context.

The session was held on 23rd August, 2025 at Wakili House, Dar es Salaam, and provided participants with not only global perspectives but also actionable takeaways to improve the effectiveness of dispute resolution in construction projects.

Our Model Arbitration Clause

Any dispute, controversy or claim arising out of, relating to or in connection with this contract, including any question regarding its existence, validity or termination, shall be resolved by arbitration in accordance with the TANZANIA INTERNATIONAL ARBITRATION CENTRE (TIAC) Arbitration Rules. The seat of arbitration shall be Dar es Salaam, Tanzania [or choose another city]. The language of the arbitration shall be English [or choose another language]. The number of arbitrators shall be one [or three, or delete this sentence and rely on Article 8 of the TANZANIA INTERNATIONAL ARBITRATION CENTRE (TIAC) Arbitration Rules]”.
